In the Renukaswamy murder case, the Karnataka High Court granted actor Darshan Thoogudeepa interim bail for six weeks to undergo surgery.
Justice S Vishwajith Shetty allowed the bail application to address Thoogudeepa’s medical needs, with a decision following extensive arguments from his senior counsel CV Nagesh and state prosecutor P Prasanna Kumar.
Medical records from Ballari Central Prison doctors and the head neurologist at a government hospital in Ballari were presented in a sealed envelope, detailing Thoogudeepa’s condition. Nagesh argued that his client suffers from numbness in both feet and requested that the surgery be done at a private hospital in Mysuru, with Thoogudeepa bearing the costs.
The prosecutor opposed this, stating that the medical records didn’t specify the hospitalization duration and suggested the procedure could be performed at a government facility. However, Justice Shetty referenced Supreme Court precedents, indicating that the State lacks authority over the choice of treatment location for undertrial prisoners.
Justice Shetty questioned Nagesh on the decision to choose Mysuru over Bengaluru, emphasizing the need for a clear timeline on the hospital stay. Nagesh reaffirmed the request for surgery in Mysuru, while Kumar recommended a state-appointed medical board evaluation.
Previously, a sessions court had denied Thoogudeepa’s bail request on September 21. Following this, he appealed to the High Court, seeking interim bail for urgent medical treatment.
